1. The agreement
Harvey Rupert, a YLM TECHNOLOGIES LIMITED company, offers the website services described in these terms. These services are supplied by YLM TECHNOLOGIES LIMITED (“we”, “us” and “our”), registered in England and Wales with company number 17408699, at 128 City Road, London, EC1V 2NX, United Kingdom. “You” means the business named in the accepted service order and the person acting with its authority.
Your service order records your plan, website address, agreed work, dates, fees, payment triggers and any additional terms. We give you the final terms and service order before asking you to accept. Acceptance must be recorded in writing, including by email or an agreed electronic process. An enquiry or a visit to this website is not acceptance of a paid plan.
The accepted service order and the identified version of these terms form the agreement. Any change to these terms in the service order must be expressly identified and agreed. Neither document removes a right that the law does not allow us to remove.
2. What we provide
We build and run a website for your surveying or utility-locating business using your chosen Trig or Paddock design. The agreed plan includes setup, migration of the agreed existing content, hosting, initial search-engine setup, ongoing SEO upkeep, enquiry forwarding and the monthly content allowance.
Your service order identifies the pages, migration scope, included features and any client-specific requirements. We obtain your written approval of the scope and price before doing additional chargeable work. Paid advertising, email mailboxes, bespoke software and third-party subscriptions are included only if the service order says so.
If you need a domain, we can acquire an available domain for you at the registrar’s cost, with your approval before purchase and no markup. The order identifies the registration period and any renewal cost. The domain is registered for your business and remains yours. Registration is subject to availability, registrar terms and any eligibility rules.
If you already have a domain, we can update its registrar or DNS settings, connect it to your new site, or arrange an agreed registrar transfer, provided you give us the access, transfer code and authorisation needed. We agree any registrar transfer or renewal cost in advance and take reasonable steps to preserve existing email and other services.
We provide website services. We do not carry out surveys, certify your professional advice or confirm your entitlement to perform regulated work. Demo firms, staff, projects and example results shown in the templates are illustrative and must be replaced or removed before your own site goes live.
3. Launch and the free month
Our advertised launch period is 72 elapsed hours. We agree the start and deadline in writing when you authorise the build. Before that, we confirm the scope, content, domain access, email services to preserve and your approver's review availability. We provide an earlier private preview for you to check. Publication needs your explicit approval of the identified version and launch details; silence is not approval. If a delay arises, we tell you what has happened, its effect and the proposed next step; a revised deadline requires your agreement. The clock does not pause or reset automatically.
Your first month is free and begins at the approved live launch. We record the trial start and end dates before it starts. Completing intake or viewing a private preview does not start the trial or accept a paid plan. If you decide not to continue after the trial, you pay nothing for the build and your domain remains yours. We do not move you onto a paid plan through silence or failure to respond. We ask for your express agreement to continue.
Separately priced third-party costs may be incurred during the trial only if you approve them in advance and are told whether they remain payable if you do not continue. They are not an undisclosed build fee.
4. Prices and payments
The current advertised prices are below. Amounts are in pounds sterling. No UK VAT is currently charged. The accepted service order records your agreed fees and total payable. If our tax obligations change, we explain the treatment in any affected future quote or renewal before you accept it; an existing fixed-term price is not increased simply by editing this page.

The optional WhatsApp add-on for Trig is £250 a year. It adds WhatsApp updates and lead alerts and increases the allowance to 20 posts a month. Paddock includes those features.
The free month and split payments apply to year one only. Each invoice states its due date. Raise a disputed amount with us promptly so we can investigate; we will not treat a genuine, unresolved invoice dispute as an automatic reason to take your website offline.
5. Lead and visit targets
We agree the lead and visit targets with you before the trial. A lead is a genuine enquiry for your surveying or locating work, such as a quote request, call or message. Spam and sales approaches do not qualify.
The written target schedule must specify the qualifying services and area, measurement tools, baseline, period, treatment of duplicates, evidence you can review and the event that makes the second instalment payable. It must also explain what happens if a target is missed or disputed. Those conditions cannot be replaced by our own judgement after the event.
Past client averages do not promise the same results for your business. Search visibility and enquiry volumes depend on factors including your services, area and competition. We do not promise a particular search position or sales outcome. Any specific target commitment and payment condition remains as agreed in your service order.
6. Updates and approvals
Every plan supports updates by email. You send the change to your allocated relay address, receive a preview and confirm by reply before publication. Paddock and Trig with the WhatsApp add-on also support updates through the agreed WhatsApp process.
A content change, new job post or job closure counts as one post. Job posts share the monthly allowance; they are not a separate add-on. Allowances are measured by calendar month: in UK time (Europe/London). We tell you when you reach the allowance and agree the next step before charging for additional work.
You nominate the people authorised to request and approve changes. Keep your relay address and approval codes private and tell us if authority changes. We may prepare previews with automated tools; your confirmation is still required. If we publish something different from the approved preview, tell us and we will correct our error without using your post allowance.
We forward website enquiries to your nominated email address. WhatsApp lead alerts are included only with Paddock or the Trig add-on. You remain responsible for responding to prospective clients and applicants.
7. Your responsibilities
You provide accurate business details, services, coverage areas, contact information and content, together with the access and approvals reasonably needed for the agreed work. You must have permission to use the material you supply, including photographs, logos, testimonials and personal information.
You check the website and previews for factual accuracy and tell us about changes to your services, registration, insurance or contact details. Any registration, licence or membership statement, such as cadastral registration in Australia or RICS or Geospatial Survey Association membership in the United Kingdom, must be accurate for the relevant work and jurisdiction. We will not knowingly publish a misleading claim or material that infringes another person’s rights.
We explain access requests and use appropriate access permissions where available. You should not send account passwords, client survey files or sensitive personal information through a general update request. Your responsibility to check content does not remove our responsibility for the work we agree to perform.
8. Ownership and permissions
Your domain remains yours, including when we acquire it for you at cost or help manage its registrar and DNS settings. We do not claim ownership of your domain because we buy, manage or connect it on your behalf. Your existing logos, photographs, text, business records and other supplied material remain yours or the relevant rights holder’s.
You give us permission to use and adapt supplied material only as needed to provide the agreed service, including through the providers used to host and operate the website. We do not use your business name, logo or results in our own marketing without your permission.
The service order must distinguish your material, new client-specific work, our reusable templates and tools, and third-party assets. It must specify any assignment or licence for the completed website and what can be transferred when the service ends. No transfer of our reusable software or third-party rights is implied by paying a hosting invoice.
9. Hosting and support
We will provide the agreed service with reasonable care and competence. The service order records support channels, hours, maintenance arrangements and any service-level commitment. Any uptime percentage or around-the-clock response commitment must be expressly recorded in your service order.
Hosting, domain services, search platforms, email and WhatsApp depend in part on third-party systems. We remain responsible for our agreed work, will investigate reported problems and will explain known interruptions and the steps we can take. A third-party issue does not remove any remedy the law gives you.
If an immediate security or legal risk requires temporary restriction, we limit it to what is reasonably needed, notify you as soon as practicable and work towards restoration. Otherwise we give notice and a reasonable chance to address a problem before suspending service. Any proposed non-payment suspension process must be set out in the agreed service order.
10. Privacy and security
Our privacy policy explains the information collected through the Harvey Rupert enquiry site and secure onboarding intake. The privacy notice for your own website must separately explain how your business handles its visitors’ enquiries and job applications.
Secure intake is for agreed website content, not CRM/customer records, mailbox contents, confidential survey files or private project records. Its invitation uses a password and a code sent to your nominated email; it is not a website management account. Never upload account passwords or access credentials. Original uploads are retained for 90 days after launch or cancellation, subject to the agreed return and notice process. Approved website assets and necessary service records are kept separately for the agreed service and applicable record-keeping requirements.
Where we handle personal information for your business, we use it for the agreed service and lawful instructions, restrict access and take reasonable security steps. The agreed data-handling schedule should identify the parties’ roles, hosting and messaging providers, overseas access, retention, return or deletion, and incident responsibilities.
We tell you promptly about a confirmed incident affecting your information, share the information reasonably needed to respond, and cooperate on notifications required by applicable law. Neither party should disclose another person’s information without a lawful basis.
11. Renewal and changes
From year two, the annual service fee covers hosting, SEO upkeep, the plan’s monthly allowance and enquiry forwarding. Before the current term ends, we give you the next term’s price, dates, included service and the process for continuing or leaving.
Renewal requires your express written agreement. We do not charge for another year simply because you did not cancel. If renewal is agreed, its fee is billed yearly in advance. Any proposed price or material service change is disclosed before you accept that term.
We do not change an accepted fixed-term price or material obligation just by editing this web page. Contract changes require agreement, except where a change is required by law and we explain its effect and your available rights.
If you do not agree to renew, the service ends at the end of the current term and the agreed exit and handover process applies. We contact you before expiry to explain the dates and next steps.
12. Ending the service
During the free month, you may decline to continue without a build fee. After you accept a paid term, the service order must explain any agreed change-of-mind cancellation rights, notice, charges and treatment of prepaid fees. Statutory cancellation and refund rights always remain available where they apply.
If either party materially breaches the agreement, the other may give written notice describing the problem and a reasonable opportunity to remedy it before ending the affected service. Immediate action is reserved for circumstances where the law or an urgent, serious risk requires it. We explain any final invoice or refund rather than automatically retaining all prepaid fees or accelerating every future payment.
On exit, we cooperate with transferring control of your domain and returning your supplied content and available enquiry data in an agreed, commonly usable format. We do not delete data or switch off hosting without the notice required by the agreed exit process, unless an urgent lawful restriction requires it. Website files, reusable code and additional migration work are handled under the ownership and handover arrangements in your service order.
13. Rights and liability
Nothing in the agreement excludes, restricts or changes a guarantee, remedy or liability that applicable law does not allow the parties to exclude, restrict or change. This includes rights under the Australian Consumer Law where it applies, including to eligible business purchases. For clients in the United Kingdom, nothing in this agreement limits any right or remedy that the law of England and Wales does not allow to be limited.
If the service fails to meet an applicable guarantee, the remedy depends on the failure and the law. It may include correction, cancellation, a refund or compensation. A contractual trial, support procedure or performance target does not replace those rights.
Each party remains responsible for loss for which it is legally liable.

If direct discussion does not resolve the issue, the parties may agree to mediation or use an available small-business dispute-resolution service. This does not prevent either party from seeking urgent relief, reporting a matter to a regulator or exercising a legal right.
Either party may bring a dispute before a court or tribunal with jurisdiction under applicable law. Nothing in the agreement restricts mandatory protections or remedies available to Australian clients.
For clients in the United Kingdom, this agreement is governed by the law of England and Wales. The courts of England and Wales have jurisdiction, subject to any rights you have that cannot be excluded.
